These terms cover your use of gcemarket.com and the enquiries you send us through it. The site is operated by GCE Market (“GCE,” “we,” “us”), [street address], Blackwood, New Jersey 08012, USA. By using the site you agree to these terms. If you don't, please don't use the site.

1. What this site is, and isn't

The site describes refurbished semiconductor manufacturing equipment, spare parts, and equipment services that GCE offers. Nothing on it is an offer to sell. Listings, specifications, availability, and pricing are information only. A sale, service engagement, or warranty exists only when you and GCE sign a written quotation, purchase order acknowledgment, or agreement, and that document governs the transaction, not these terms.

2. Equipment and parts listings

  • Availability. Items marked “In stock” are held by GCE at the time the listing was updated. Items marked “Available to source” are not in GCE inventory; GCE can source, refurbish, and support them on request. Either status can change without notice.
  • Specifications. Model specifications, wafer sizes, throughput, and similar figures reflect the platform as GCE typically configures it. Your system is built to the specification in your quotation, which controls over anything on the site.
  • Photographs and renderings. Some images show representative or rendered equipment, not the specific unit you would receive.
  • Lead times. Any delivery or turnaround period on the site is indicative. Committed dates are set in your quotation.
  • Trademarks. Canon, KLA, and other manufacturer names are the trademarks of their owners. GCE is an independent refurbisher and is not affiliated with, endorsed by, or an authorized agent of any equipment manufacturer unless expressly stated.

3. Quotes, demos, and enquiries

  • A request for a quote, demo, parts, service, or advisory call is an enquiry. It does not create an order or a commitment on either side.
  • Quotations GCE issues are valid for the period stated on them and are subject to availability, export approval (see section 4), and GCE's written terms of sale.
  • Equipment demonstrations are offered at GCE's discretion, without obligation, and on in-stock systems. A demo is not a performance guarantee for any specific unit.
  • You agree that the information you submit in an enquiry is accurate and that you are authorized to submit it on behalf of your organization.

4. Export control and sanctions

Semiconductor capital equipment, parts, and related technical data may be subject to U.S. export control laws, including the Export Administration Regulations, and to sanctions administered by the U.S. Treasury. GCE will not quote, sell, ship, or provide technical data where doing so would violate these laws. Every quotation and sale is conditioned on GCE obtaining any required license or authorization, and GCE may decline or cancel an enquiry or order for compliance reasons without liability. By submitting an enquiry you confirm that you are not located in, organized under, or acting for a country, entity, or person restricted under these laws.

5. Using the site

You may view, download, and print material from the site for evaluating GCE's equipment and services. You may not copy it for republication, scrape it, reverse-engineer any software on it, remove copyright or trademark notices, or use it in a way that interferes with the site or other users. GCE may suspend access for misuse.

6. Content and intellectual property

The site's text, photographs, diagrams, technical drawings, videos, case studies, and design are owned by GCE or used under license and are protected by copyright and trademark law. Case studies and testimonials describe specific past engagements; outcomes for other customers will differ.

7. Third-party links and tools

The site links to third-party sites (for example, manufacturer sites, LinkedIn, and scheduling tools) and uses third-party services for hosting, forms, analytics, and cookie consent. GCE does not control those sites or services and is not responsible for their content or practices. See the Privacy Policy for the services we use and how data is handled.

8. Disclaimer

The site is provided “as is.” GCE works to keep it accurate but does not warrant that it is complete, current, or free of errors, and may change or remove content at any time. To the fullest extent allowed by law, GCE disclaims all warranties about the site, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. This section is about the website. Warranties on equipment and services are set out in your sales or service agreement.

9. Limitation of liability

To the fullest extent allowed by law, GCE and its officers, employees, and agents are not liable for any indirect, incidental, consequential, or special damages, or for lost profits, revenue, data, or production time, arising from your use of or inability to use the site or its content, even if advised of the possibility. Where liability cannot be excluded, it is limited to the greatest extent permitted. Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnity

You agree to indemnify GCE against claims, losses, and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the site.

11. Privacy

Personal information you provide through the site is handled under the Privacy Policy, which forms part of these terms.

12. Changes

GCE may update these terms. The “Last updated” date at the top shows the current version. Continued use of the site after a change means you accept the updated terms.

13. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. Any dispute about the site or these terms will be brought in the state or federal courts located in Camden County, New Jersey, and you consent to their jurisdiction. This clause covers the website only. Disputes under an equipment or service agreement follow that agreement.

14. General

If any part of these terms is unenforceable, the rest still applies. GCE's failure to enforce a term is not a waiver. These terms, with the Privacy Policy, are the whole agreement about your use of the site.
